Terms and Conditions of Funds Transfer
These terms and conditions are an "Agreement" between you and ACLEDA Bank Plc, please carefully read these terms and conditions to understand in relation to the use of Funds Transfer.
CUSTOMER'S RESPONSIBILITY
- You must ensure that all information provided are true and correct.
- In case of changing information, delaying payment, or cancelling funds transfer transaction, please notice to ACLEDA Bank in writing, by E-mail, or through other electronic means.
- You must affirm that this funds transfer transaction whether conducted personally, on behalf of relatives, or as a payment under a contract is valid and in full compliance with national and/or international laws.
- You must to cooperate and agree in providing related supporting documents in case of the bank requirement.
- Financial Relationships occur when the two transactors, particular business enterprise are affiliated. This means one of transactor directly or indirectly holds partial or full ownership of another transactor:
FINANCIAL RELATIONSHIP
- Relationship (R): If the resident transactor/nonresident transactor is a direct investment enterprise of nonresident transactor/resident transactor who has 10% or more of share ownership in enterprise.
- Non-Relationship (N): If resident and nonresident transactors have no share ownership whatsoever or have share ownership less than 10%.
- Don't know (DN)
- You are fully responsible for the accuracy of the supporting documents related to the fund transfer transaction and shall bear all legal liability in connection with the documents provided. This includes any loss, block, refund, freezing or cancellation of the fund transfer in the event that the bank, the correspondent bank or intermediary bank is unable to process the transaction, or if it is found that the transaction is involved in unlawful activities and/or violations of national and/or international laws/regulations.
FUNDS TRANSFER
- The transaction will be executed after ACLEDA BANK PLC have received the transfer application form or a request submitted via ACLEDA Internet Banking, AC Super App, or an instruction by Banking Service Order via E-mail from you.
- The Bank will execute the payment transaction based on the information specified in the application form, or the request submitted via ACLEDA Internet Banking, AC Super App, or an instruction by Banking Service Order via E-mail. In the event that you provide incorrect, insufficient, unclear, untimely, or fraudulent information, you shall be responsible for any losses and related expenses.
- The funds transfer transaction in other currencies beside Khmer Riel and US Dollars, even though the beneficiary has an account or no account, the customer could be withdrawn when the bank has sufficient reserves of that currency. Otherwise, they have to withdraw in Khmer Riel or US Dollars according to the bank's prevailing currency exchange rate of ACLEDA Bank.
- For Fund Transfer transactions to non-account recipient:
- For Fund Transfer transactions to non-account recipient, the transfer amount can be kept in the suspend account in 90 days only. Thus, the sender has to contact the recipient to withdraw money timely.
- After receiving inward fund transfer, in 90 days without the recipient's present (the recipient has no account), that amount will be delivered to the sender.
- In case of the sender or recipient requests to withdraw the funds from the 91st day onward, the request must be accompanied by the relevant transfer documents (for the sender) or a questionnaire/identity verification letter (for the recipient). The Bank will then return the funds to the sender or the recipient accordingly.
- For the request termination of the transaction, ACLEDA Bank will return the transfer amount only whereas the transaction fee will not be returned. Overseas funds transfer, the customer will receive the actual amount after correspondent bank return the fund (in case currency return differ from account sender, the bank will credit to sender account based on actual exchange rate) or will not receive, if the recipient at abroad does not allow to return to you.
- Fee "OUR" means that ACLEDA Bank guarantees the full amount sent to beneficiary bank. However, the beneficiary's bank may charge additional service fees to the overseas beneficiary in accordance with its internal policies, and the beneficiary must bear these extra fees entirely.
TYPE OF CURRENCY
Available currencies for the remittance services are KHR, USD, THB or other currencies that ACLEDA BANK PLC. has officially launched. In case of any transaction in different currency, the amount of withdrawal will be converted to be KHR or USD according to the prevailing currency exchange rate of ACLEDA Bank at that time.
FEES CHARGE
- You must check the officially service fees launched or the agreed fee before deciding on each transaction and agree to allow the bank to deduct money from their account to cover the fees and other related expenses.
- The transaction fee that was already agreed will not allow any modification or change without the consent of the eitherparties.
- For Overseas funds transfer via SWIFT, the Bank may request you to pay for additional fees on any information modifications or inquiries for information in cases where requests are made to banks abroad.
CONFIDENTIALITY
ACLEDA Bank will not disclose all funds transfer information to any person, except to the following cases:
- ACLEDA Bank requires information for preparing report, auditing or other relevant activities required by the law.
- In case of court citation or authority use for investigating or processing any unlawful conduct whether you have involved directly or indirectly.
PRIVACY NOTICE
- We may collect, and store any information provided by you such as Receiver Name, Sender Name, Sex, Mobile Number, Account Number, Address, ID Number, Loan No., and any other information in order to perform Fund Transfer for you.
- We will use your personal information for any of the following purpose:
- When banks administer and processes your funds transfer transaction.
- When required by law or regulations.
- Deliver our services available.
- Improve/advertise our products and services.
- We will share your personal information with third party or services provider we engaged with to administer and process any payments transactions.
- We store your personal information with reference of our data retention policy. We may still store your information for a longer duration where we need the information to comply with regulatory or legal frameworks or for our legal obligations. When your information is no longer need a stated in the retention period or reason above, we will securely destroy, delete or anonymized it promptly as per Data Disposal Policy.
- We are committed to ensure that your personal information is in a high security manner and confident. We protect your personal information by applying high security mechanism, including technology with high availability of infrastructures, encrypted with strong cryptographic key and complies industry security standards to prevent any unauthorized access, collection, use, disclosure, copying, modification, disposal, or other similar risk.
INDEMNITY
- You unconditionally agree to indemnify and compensate the bank against all losses, claims, costs or expense which the bank may incur as a result of processing funds transfer.
- You authorize the bank to debit cash from your account in order to indemnify all claims as mentioned above on the actual situation.
OTHERS
- These terms and conditions are subject to change frequently in order to comply with national and/or international law.
- These terms and conditions are made in both Khmer and English, so if there is any inconsistency between Khmer and English versions, the terms of Khmer version shall prevail.
- Relevant parties have thoroughly read and fully understood all provisions contained in these terms and may accept them through any electronic means made available by the Bank.
